Compensation From Asbestos Bankruptcy Trust Funds

After the link between asbestos exposure and illnesses such as mesothelioma or asbestos lung cancer was made public, thousands of workers and their families who were exposed to asbestos filed lawsuits against companies that manufactured, sold, or used asbestos products.

Because of these lawsuits, many of the companies that were heavily involved in the asbestos industry were forced to declare bankruptcy.

In order to ensure that victims of asbestos exposure were compensated for their illnesses, many of these companies were required by the courts to set up bankruptcy trust fund.

There is currently more than $30 billion of compensation in these asbestos trusts available to workers who were exposed to asbestos and their families.

Some of the largest asbestos trust funds include:

  • Armstrong World Industries ($2.06 billion)
  • Babcock & Wilcox Company ($1.85 billion)
  • Celotex Corporation / Carey Canada, Inc. ($1.25 billion)
  • Combustion Engineering ($1.24 billion)
  • DII Industries, LLC  aka Dresser Industries ($2.51 billion)
  • Johns-Manville Corp. / Philadelphia Asbestos Corp. (Pacor) ($2.5 billion)
  • Kaiser Aluminum Corp. ($1.22 billion)
  • MacArthur Co. / Western Asbestos Co. ($2 billion)
  • Mid-Valley Inc. (Halliburton) ($2.51 billion)
  • Owens Corning ($3.42 billion)
  • Owens Fibreboard Corp. ($1.56 billion)
  • Pittsburgh Corning Corporation ($3.4 billion)
  • United States Gypsum Co. / USG Corp. ($3.96 billion)
  • W.R. Grace & Co. ($2.98 billion)

Filing an Asbestos Trust Claim

If you or a loved one worked at one of the companies listed above or at an asbestos jobsite where products manufactured by these companies were used, you may be eligible to file a claim with an asbestos bankruptcy trusts and receive compensation.

Family members may also have the right to file an trust claim if a loved one passed away from mesothelioma, asbestos lung cancer, or another asbestos-related disease. In cases where the individual is too ill to file a claim themselves, a spouse or family member can take legal action on their loved one’s behalf.

According to a study by the RAND Institute, the average payout for asbestos trust claims is about $126,000, with some claims exceeding $1.2 million.

The exact value of each asbestos bankruptcy trust settlement depends on several key factors, including the type of asbestos disease that is diagnosed, the scheduled value assigned by the trust fund, and the trust’s current payment percentage.

Asbestos trust claimants are not limited to a single fund. Because many workers were exposed to asbestos from products made by multiple companies, it is often possible to file claims with more than one asbestos trust fund.

If eligible, filing a claim with multiple trusts increase the total compensation available to asbestos victims and their families, helping them cover medical expenses, lost income, and the lasting costs of asbestos-related diseases.
